Can my flight school hold me to taking a check ride with the FSDO?

I am in a reduced hour commercial 141 program that allows me to take the ride below the normal 190 hour 141 requirements. My school is seeking in-house examination. Because of that, we need to go through the FAA and get 10 first-time passes with them.

Unfortunately, the specific inspector from the FSDO that conducts these rides is known to have a very low pass rate, hovering around 40%.

I am under the impression from my school that I absolutely have to take this ride with the FSDO, unless they specifically say that they are busy, or can be sent to a DPE.

Is this the case, or am I entitled to take the ride with anyone I please, such as a normal DPE?
 
I partly addressed this in your other thread. Sounds like the FSDO is being pretty hard on the school making them use a DPE with such a low pass rate and yet they must have 10 first time passes. I don't know how the in house examiner thing works. What would happen if you said screw it and suspended yourself. Say you can't take it anymore and need to concentrate on your degree. Say you ran out of money. Then wait until they work thru the mess with the FSDO and get self examining. After that, when you are ready, you could rejoin the program. Personally, I think it's a pretty high expectation to be taking the commercial at less than 190 hours (under 141). Never heard of that.
 
I have on occasion sought out my own/preferred DPE (for Commercial/MEI checkrides).

I know Schools have one they prefer, but you are the one paying.

You posted this in a legal context so until someone who can authoritatively say so, I’ll give you my .02 since I worked for a place with self-examination authority.

The school can’t force this on you, IMHO, but they don’t have to keep you as a student either. They need the passes to get the authority.
