This is preliminary information, subject to change, and may contain errors. Any errors in this report will be corrected when the final report has been completed.
On May 5, 2004 at 2115 eastern daylight time, an unregistered Gary Bergmann experimental aircraft, Rans S-12XL, N8KD, operated by a noncertificated pilot, collided with power lines and trees during a low-pass over runway 21 at Mathis Airport in Cumming, Georgia. The flight operated under the provisions of Title 14 CFR Part 91. Visual meteorological conditions prevailed at the time and no flight plan was filed. The airplane was substantially damage. The noncertificated pilot was fatally injured. The flight departed Mountain Airport, Cleveland, Georgia, at 2015 on May 5, 2004.
The purpose of the personal flight was undetermined. Witnesses at the airport stated it was dark outside, so they lit the unlighted runway with their car headlights. The noncertificated pilot passed over the runway twice, and on the third low-pass the airplane was about 50 feet above the ground. Witnesses observed that the airplane almost hit the airport's wind sock which was on top of a 50 ft. oak tree. The airplane banked left in the north-east direction to miss hitting the wind sock. Witnesses stated the airplane appeared to stall after the turn. Witnesses lost sight of the airplane, but heard the ballistic rocket system on the airplane detonate. The airplane collided with trees and a nearby power line, at which time a utility transformer blew.
