Aerial Photography question

hi,

If a pilot/photographer, who's business is to offer commissioned aerial photography service, hires a local flight school's C172 and an instructor* to take commissioned aerial shots of a construction site for a client, would the pilot/photographer be subject to any FAA regs on commercial operations (e.g Part 91 or 119) or license requirements (e.g CPL)?

*The photographer and instructor will share flying duties (e.g fly to the site and back), but the flight instructor will fly while the photos are taken for safety reasons.
 
if the pilot is getting paid that would be a commercial operation. However, In 119 airial photograhpy is one of the activities NOT requiring a Commercial Operators Certificae.

You're good to go.
 
The pilot needs a Commercial certificate. Other than that there aren't too many rules that apply. No sharing of pilot duties required.

If the pilot/photographer is not CPL, then I think the CFI would have to be PIC (doesn't matter who's actually handling the controls). Otherwise, I think you'd be good to go.
