Rumot has it that the ALPA organizing committee at SkyWest has filed a federal lawsuit against SkyWest for obstructing the union petition drive....film at eleven.
It's not a rumor, it's rumot.![]()
Source: one of the plaintiffs.Interesting... any source to this or strictly rumor?
For the ignorant (me), I don't understand why SKW would HAVE to allow union marketing on it's territory just because they have a pilots association? An association is not a union right, or SKW would be unionized and it's not (yet). Just trying to understandHere's a letter from SkyWest's organizing committee outlining the details of the lawsuit. I'm told they were granted a restraining order against the company today pertaining to all or most of the letter's bullet points.
A little bit of trivia: Supreme Court Justice Stephen Breyer's son is hearing the case.

The railway labor act says that a company cannot interfere with it's employees trying to organize, and that's the organizing commitee's position.
Now the only concern is how nasty is the relationship going to get if the pilots actually vote for alpa representation. Apparenty the organizing commitee has chosen to complain and sue instead of improvising. I'd much rather they fight for important things rather than the right to put pamphlets in the crew rooms (which they are doing anyways).........
Ahh...how are they going to fight for anything before they're on property boss man?

Here's the problem with that: Union representation is an issue between management and labor. ALPA shouldn't be fighting to be on Skywest's property. It is for the Skywest pilots to decide whether or not they want ALPA to represent them. It is not ALPA's place impose representation on the Skywest pilots, by forcing their way onto the property.
The proper thing to do is to provide information for those that want it, but otherwise to stay out of the dispute until they receive the required amount of cards back from the pilot group. If and when that happens, then they can proceed with an election. If they do not, then that is pretty good indication that ALPA is not wanted. And why go somewhere you are not wanted?

An employer cannot impose greater restrictions on union solicitations than it imposes on solicitations for any other organization. The issue here is that Skywest apparently has allowed one association great freedom of access to Skywest employees, but is attempting to deny the same access to the organizing committee. That is illegal.
And anyone who gets pissed off just because the organizing committee is trying to provide information needs a serious attitude adjustment. The employer is not your friend. The information the employer provides to you is highly biased and likely false. You should welcome some information from the other side to balance the information you are receiving.
Of course, if you prefer to be ignorant, I guess you have that right.
I like having labor attorneys on the website, it's like having Cat-III autoland.
