Given FAA is in strict rule making mood, likely they adopt DX required for 91/91k/135 for aircraft with sitting capacity above C ( x ) .

Haven't dug too much into it, but this stood out:

Looking at the ILS there you couldn't do that approach. You could do the LOC and needed a mile vis. Weird how that restriction doesn't apply to the LPV.
 
What's their ALT was given fuel/range constraints? Was asking SOCAL App for WX ALTs--check SDM, check, SEE, "uhh not great but we'll give it a go" -- not sure what they were expecting going into SAN area overnight/morning hrs without a solid ALT (typical go to ALT for these overnights into that area is PSP/ONT given the marine layer, and its a couple hundred pounds more for lights jets). Seems like they were flight planning mid flight, "I'll come back to you with an alternate just in case"--"hopefully not see you but we might have to".

Been out there working the past few weeks around a number of airfields, and MYF has had inop approach lighting components for a while. Shouldn’t have been a surprise, at least not with adequate prep time and not a last minute thing. Indeed interesting it doesn’t apply to the RNAV approach, 3/4 mile viz still allowed

Definitely some weird stuff out in that area like this. At SEE, there’s been a longtime NOTAM that keeps referring to an ILS 27R, which SEE doesn’t have. They only have a LOC circling approach.
 
The guy sounds pretty nonchalant, with no exit plan for alternate? He’s talking to the approach controller. That’s pretty late for alternate planning. Why not discuss this at TOD minus ~50-100 miles? If the ASOS at Montgomery is broken, then it gives plenty of time to get weather from surrounding airports like Gillespie, Brown, SAN, etc.
