interesting emergency authority reg

According to the regs, as PIC you have the emergency authority to "exclude any any all persons" from the flight deck in the "interest of safety" with this reg in place could you in theory deny a fed or a LCA from the flight deck in the interest of safety? Im sure that you would have to explain for it but could you say you did it in the interest of safety as you were not up to doing a LCA ride or a fed ride? Might be a stupid question but Ive always wondering if anyone ever tried to deny a fed or LCA under the guise of emergency authority.
 
Are you kicking someone out in interest of handling an emergency or just preventing someone from getting up there in the first place? Sure if me and the FO are fighting to keep the airplane from falling apart and the LCA or Fed is asking me what we are planning for dinner he is getting sent out. Now If I am stowing my bags and Mr FAA or Captain Line Check comes strolling down, sure I can tell them I refuse to let them in my jumpseat because it makes me uncomfortable and it could lead me to making a mistake. I also fully expect I'll be dequaled and pulled off the line in less than 12 parsecs.

Speaking of checking events, for LCA checks do they ask you random reg questions like some of the feds do during a fed check or do they just sit back and watch you fly?

Every line check I've had we just chill and talk bad about the company. In my OWN experience the only time Feds ask a question is if they don't understand a policy or procedure.
 
Oh man, I have a great story about a LCA being denied the jumpseat when he was supposed to perform a line check...

...but it's a story that pairs well with beers.

Do tell, im down for a good story. Im guessing the CA who denied the LCA the jumpseat got called to the CPs office.

I feel like I've seen more than one memo at my company "clarifying" jumpseat priority when accommodating an faa employee. There has to have been something to spark that.
