Reporting an Employer to ICE?

What sort of preparation is required? Are they going to charge him with "failing to report an Auslander"? What's wrong with "yeah, I knew about it, but I didn't want to get fired. Then I got fired."?

It makes the case look more like sour grapes if you're going after them after the fact. Thats why its best if he has his facts and doesn't go off half-assed to the authorities, with rumor and innuendo as some are implying he does, rather than with fact and reasonable documentation. If he doesn't, he might be opening himself up for a civil suit from them.
 
The immigration service is a complete mess. It's very unlikely that any report you make will even be linked to the right employer or aliens.

That said, the chances are they're doing what they do completely legally. M1, F1 and J1 all have provisions to allow aliens to work here for a period, not necessarily while training at the same time.

There's also a chance that they are working legally without documentation. Don't ask how that's possible!

There are so many pitfalls, that unless you know something for a fact, or really hold a grudge, it's probably not worth it.
 
I would agree with the above post. I mean if they are signing people off for checkrides than their names are being put through the FAA database because the FAA keeps tracks who signs off who. I'm pretty sure the FAA would catch on that these are illegal workers. I could be wrong though.
Wasn't there some news article a few months back about watch-list placeholders or known terrorists holding pilot certs? I think some news org or database company ran a comparison, IIRC. If the feds can't find them using their own database, I don't hold out much hope for them finding anyone NOT actively trying to destroy the US.

And James, like MideD and Stratopilot just said I'd worry about them coming back on you since you left on not so good terms.

If you did tell the Feds, and you ended up being wrong, the company could always slap you with liable, slander, and malicious or false prosecution.

Never screw with someone that has access to better connections and has more money that you do. You'll lose every time.:dunno:

We're talking about a flight school here, not a fortune 500 company. Most flight schools can barely afford to pay the bills, much less have an attorney on retainer.

Sour grapes or not, if there is illegal hiring practices going on at this place, ICE is not going to avoid taking action simply because the information came from a disgruntled employee.

I agree that it would be helpful if he can gather as much information as possible. However, it's ICE's job to form a case and investigate formally. Not his.

What is this employer doing? Well, by illegally hiring people who are here on student visas so they can save money on wages, they get an unfair advantage on legitimate businesses. Those legitimate businesses may not be able to compete, because they actually pay people who are eligible to work here.

That means those legitimate businesses may have to lay off workers or not hire workers.

So, the company that is hiring people illegally is not only shafting its employees, it may very well be shafting other company's employees.

Report the son of a bitch and help send him to a pound me in the rear prison. He deserves it.

Do it anonymously. They can investigate and learn what they need to learn on their own. I'm sure there's a number you can call from the phone at a Denny's or something to report them.
 
I am confused at how they have FAA Certificates?

JHUGZ, were they brought here as actual students and worked their way up to CFI and now haven't returned?

After my former employer bounced my final payroll check I called Immigration on them. Not so much for revenge but because of safety. OSHA was making too many visits to the plant because the new super employees weren't comprehending safety instructions in English very well. They were also handling sensitive government materials. The ICE peeps were there within a few hours. I remained anonymous.

You got it partner! Too busy with other stuff. If we were to be able to do that, there's be no Filiberto's open, most of the Subways and many other restaurants would be shut down, and a good amount of of hotels wouldn't have housekeeping or grounds staff.

It should. But if worked there, he'd hopefully come with something that a reasonable case could be built on. He doesn't need to show up with an airtight case of any kind, but something a bit more than rumor that can be looked at. He may already have that, I don't know. Am just saying what he'd need. With the amount of work most LE agencies, especially ICE/BP etc have, to get them to take your complaint with any timely manner of action, you gotta make it more interesting than the others. Thats all. I'm in full agreement with you of what should happen, it's just the how to make it happen that he needs.

Like a resume.....needs to stand out a bit from the rest.

For those with a healthcare bent, JACHO is in da haus here today. Same idea as when a bunch of FSDO types show up 'to help', only with more silly knees-bent running around advancing behavior.

Oh, and those of us in NeOhio know very well of one local school that has lawyers on retainer, and will sue basically anyone, anytime.
