Smoked pot in the last two years.

My new student went to an AME today for a medical.
They asked, "Have you smoked pot in the last two years." He said "yes."

He tells me that he has passed the drug test though.

He was told to wait for a letter from the FAA.

My questions:
What can I tell him to expect in that letter?
What are his chances?
Any points for his honesty?

There is no question about drugs unless he made some statement to the AME that raised suspicion or smelled like weed. Likewise, there is no drug test at the flight physical. It sounds like the facts are mixed up. Did he report an arrest? Did he report a DUI? If the medical was deferred, what the FAA does will depend on these unknown facts. They may ask for records or they may ask for a drug sample to be sent directly from the lab to them.

On the medical app, question 18n asks: "Have you ever in your life been diagnosed with, had or do you presently have... substance dependence or failed a drug test ever; or substance abuse or use of illegal substance in the last 2 years."
 
I know many of you will kring at this, but here it goes. Lie, if you can pass a drug test, meaning, you have smoked dope in the last few years and it has been longer then lets say a few months and you plan on very doing it again, why confess. Two years for weed, come on. We all go through our early 20's, late teen years. I might have been lucky, but who knows, In college I played sports, I passed my NCAA required drug tests. But I might have smoked some cheeba over the years. Have not done it since the late 90's. But I was told by the older players, only ansewer questions that you can be caught in a lie with truthfully and the rest be vague. And yes a few of my fellow teammates are in jail, college football what do you expect.
 
and risk the consequences of falsifying an official document in the 0.001% chance you do get caught? Eeeek. :eek:

Okay thanks doc, I will try ask for a little more information and try and get things straightened out.
 
Have any of you read the part on the 8500-7 about " all the above is true" if you lie or "not say anything", you can go to jail or pay a fine if it you get caught!

And if you decide to "omit" the said information keep your enemies close and your ex's closer!!;)
 
The best policy is to be honest about it.

Trust me, if an employer asks the question, they're not asking if you've done any drugs, they're probably querying your honesty.

Remember folks, the question wasn't about the morality of doing drugs at any point, it's a question on a form where the FAA demands complete honesty, whether you agree with it or not.

Doc, It turns out it was like Matt152 said, "or use of illegal substance in the last two years".
He checked yes.
He has no convictions for it. He did not report a DUI.

Since there were no convictions, I'm assuming there will be no records to be sent in.
I will tell him there may be a drug sample sent to the FAA.

I am figuring there is a good chance he will get his medical, is that a good assumption?

Hey Guys,

I went for my 3rd class a couple of months ago and I answered yes to that questions. I had a DUI conviction back in 1998. The FAA sent me a letter later that month and said another problem with alcohol could result in me having my medical pulled.

My CFI asked me why I answered yes to that question. My response was "what happens in 2 years if I decide to try my hand at commercial aviation and the company I am interviewing with finds out I lied on my medical?"

It is what it is. But if you lie you have to remember the lies you tell. Much easier to remember the truth.
 
They sent you a letter saying if you got in trouble with alcohol again you could lose you medical? I know a guy with two DUI who still has a medical so why they being so harsh with you?
